The terms and conditions (the "Terms") are the terms on which this website is made available to you (“You”). Our other services which include text chat, chat lines, live 1-2-1, confessions and video downloads as more particularly described below, (the "Services") are made available to you. By accessing the Website or Services You agree to be bound by these Terms.
1. INTRODUCTION
1.1 By using our Website and/or Services you accept these terms and conditions and enter into a legally binding agreement with us.
1.2 We reserve the right to vary the terms and conditions at any time and post any updated terms and conditions on the Website. Any amendments to the terms and conditions shall take effect from the date of publication on the Website.
1.3 You are responsible for regularly reviewing and shall be bound by the terms and conditions that are published on the Website from time to time. If you do not agree with the terms and conditions at any time then you should cease to use the Website and Services.
2. USERS
2.1. All users must be at least eighteen years old. Anyone who is under the age of 18, or pretends to be under the age of 18 will be removed from the site. Also any person who knowingly interacts with users who are either under the age of 18 or pretend to be under the age of18 will also be removed. We reserve the right to remove any users from the service without notice.
2.2 Any users who are found to be entering information regarding anything deemed illegal by law will also be removed from the site without notice, and where necessary details of this user may be passed on to local authorities.
3. SERVICES
3.1 We provide you with a website that enables you to chat to other users and monitors which are all UK based. The website enables you to set up a profile, upload pictures and videos and to chat to other users at the cost agreed in section 4.1. This service enables members to chat via computer or mobile. If you are logged on to the website, all interactions will be sent to your account. (“internet user”) Once you log out from the internet any messages sent to your account will go to your mobile. (“mobile user”)
3.2 Use of our phone chat services are charged at 10p per minute from a BT landline, other networks and mobile charges may vary. Our chat services cannot be accessed from outside the UK and will appear on your phone bill.
3.3 Use of our live 1-2-1 service will be charged at £1.50 from BT landlines other networks and mobiles may vary. All operators who receive calls via live 1-2-1 calls are genuine.
3.4 All calls made to our recorded confession will be charged at £1.50pm from BT landlines, other networks and mobile calls may vary. All stories are purely fictional and all characters are over 18.
3.5 All videos in our video section are either owned by chattube or have been uploaded by other users. If users upload a video to their profile page and accepts the terms and conditions for that video to be displayed on our videos page it will remain here until chattube decides to remove it and will remain chattubes property.
4. CHARGES
4.1 All charges for the text service must be agreed upon creating a profile or permission to use the services will not be granted. Charges include 75p to send messages, (“mobile and internet users”) 25p to receive user’s info (online “mobile users” only as defined in section 4.2) and 50p per user pictures recieved (only online “mobile users” as defined in section 4.3)
4.2 Online (“mobile users”) users will be defined by those who send JOIN to 88211. Once a user is online they will receive other online user’s profiles to their phone. The profile will contain a distance in miles, and will be sent the closest online users first, until they log off by sending END to 88211. Or if a user is idle for a period of 2 hours they will automatically be logged out. This will then deem the user as offline. Offline users can still exchange messages with other users User’s profiles may contain pictures usernames and other information. (Costs detailed in section 4.1)
4.3 Online users are defined in section 4.2. Once online photos which are received through users profiles will be charged at the profile rate (as stated in section 4.1). Users may also request a particular users picture by sending the word PHOTO followed by the 6 digit user number to 88211. Users will then receive the picture requested and an additional 2 pictures which are chosen at random. All photos sent out are sent in batches of 3.
5. BILLING
Billing is done by way of mobile billing or credit card billing. All users will be billed by way of mobile billing unless a credit card payment is made.
5.1 Mobile billing is charged in £5 increments. When new users join the service they are given £5 free credit and will then be billed at £5 in advance thereafter. If a billed message is unsuccessful we will allow the user to continue to use the service for another £5 worth of usage. If another billed message is then unsuccessful the user will be temporarily barred and asked to contact our customer service team.
5.2 Mobile top ups can be made by “internet” users who choose to top up their account for future usage. This can be done by accessing “My Profile” and selecting the “Credit” option on the right hand side. If a user chooses to top up their account by mobile billing billed messages will be sent to the mobile in £5 increments. So if a user selects £30 they will receive 6 billed messages. A user’s account will only be topped up by the amount of successful billed messages received. Users will be notified of the successful amount credited to their account.
5.3 Credit card payments can be made by using any credit/debit card. This can be done by calling our customer services team between 07:00 and 22:30 Monday – Sunday. All card payments are processed in house and card details are then destroyed.
6. ADULT/ NON ADULT USERS
Adult and non adult users are defined by the information that their network holds on their mobile number. Non adult users will not be able to discuss anything of an adult nature until this information is updated. Ways in which to do this are detailed below.
6.1 “Non adult” users/ users who are “not adult verified” will not be able to send or receive anything of an adult nature. This includes swapping personal details. This applies to both internet and mobile users. This also applies to users profiles that may be sent to your mobile. No adult content will be sent. Anything of an adult nature that a “non adult user” may try to send will be edited by our moderators whilst you are still registered as a “non adult user”
6.1.2 When both parties are deemed as being “adult” users they will be able to discuss matters of an adult nature and swap personal details on the sms service. However if one party is not an adult user and adult content is being sent, our team of moderators will edit the message, taking out anything of an adult nature, on both messages sent and received. If a user has adult content on their profile you can view this via internet or mobile.
6.2 ADULT VETIFICATION
Orange – Orange Safeguard:
If you are over 18 years removing Orange Safeguard is straightforward. Just call Orange Customer Services (150 for Pay Monthly customers or 450 for Pay As You Go customers) or visit an Orange shop. If you are 18 or over, you can remove Orange Safeguard by simply taking photo ID that gives details of your age (passport, photo driving license, EU & Swiss National Card, Citizen Card) to an Orange shop, and one of our Phone Trainers will remove the service from your account.
T-Mobile – Content Lock:
If you're over 18, you can remove Content Lock in 2 minutes - we just need your credit card details or name and address so we can verify your age (it won't cost you anything). You can confirm your age by: Trying to access a blocked site and entering your details when asked or dialing 1818 from your T-Mobile phone and following the prompts. If you're a pay monthly customer, you can remove Content Lock online in My T-Mobile in 3 easy steps:
1.Sign up or log in to My T-Mobile (it's free and only takes a few minutes)
2.Select 'Phone'
3.Select 'Removed' under 'Content Lock' and click 'Set'
When you use your credit card to confirm your age we'll take £2 and then give it straight back to you. 'Content Lock Removed' - will appear on your credit card statement to help protect you from fraud.
Vodafone – Parental Lock:
If you are over 18 years old, removing Vodafone’s Parental Lock is straightforward. You can call Vodafone Customer Care on 1555 or through Vodafone Live or in any Vodafone store. You will need to provide your account password, confirm you’re 18 or over; and provide credit card details (£1 will then be charged to your card and immediately refunded) or photographic ID if you’re unlocking in store. You will receive a text message to confirm when Parental Lock has been removed.
O2 - Unlock 18+ Content
We respect our customer's freedom to choose what material they access, but equally we want to protect our younger customers. Before you are able to view 18+ commercial content, you will have to prove that you are old enough. The first time you use a credit card to prove to us that you are 18 or older we will charge £1 to your credit card and credit £2.50 to your mobile account. Please note that each time you age verify, your credit card will be charged £1. You will only receive £2.50 credit when you use this service for the first time.
Three – Adult Barring
Access to adult visual premium rate services is automatically barred on our mobile phones, unless your mobile has been verified as belonging to an adult. Whether you’re on Pay Monthly or Pay As You Go, if you’re over 18 you can set up an adult security PIN on your mobile by going to Planet 3 / My3 / My Security. If you’re on Pay Monthly, you can also call Customer Services to request the removal of adult barring on 333 from your 3 mobile or 08707 330 333 from any other phone. For Pay As You Go customers you can call 444 from your mobile or 08707 330 444 from any other phone.
7. TERMINATION
7.1 Profiles can be terminated at any time from the website by either accessing your profile and deleting it or contacting our customer services team who will do this for you. Once a profile is deleted it will no longer be seen by “internet” or “mobile” users however it will be archived for the term of 6 years designed by law. If a user decides to join the service again with the same mobile number within 6 months of deleting it there old profile can still be accessed, however if the same mobile number accessing the service after 6 months they will have to start the whole process again. Mobile users can terminate there profile by sending STOP to 88211. Again this can be accessed again within 6 months as stated above.
7.2 Promotional messages may be received by users who enter any of our services. We will use your data to offer you other like services by sms. To stop any promotions you can send PSTOP to 88010 at any time or contact our customer service team.
8. YOUR OBLIGATIONS
8.1 You shall use the Website and Services in a manner consistent with any applicable laws and regulations and shall perform your obligations set out in the terms and conditions.
8.2 In particular you shall NOT:
8.2.1 use the Website or Services for illegal purposes or infringe any third party’s rights, including but not limited to privacy rights and/or intellectual property rights;
8.2.2 behave in a way that is offensive, racist, abusive, obscene, threatening or libellous in your use of the Website or the Services;
8.2.3 use the Website or Services for commercial or business purposes (other than as specifically permitted in this agreement);
8.2.4 attempt to gain unauthorised access to any information available on the Website or Services or to any of the networks used in providing the Website or Services;
8.2.5 misuse the Website or Services in any other way.
8.3 You shall not use the Website or Services to engage in, promote or refer to any the following:
8.3.1 paedophilia or any references to sexual acts with minors, including adults role-playing as minors;
8.3.2 any sexual activity which involves or implies lack of consent from the participants, such as rape or physical restraint (whether real or simulated);
8.3.3 violent, degrading or humiliating sex;
8.3.4 bestiality;
8.3.5 prostitution and pimping;
8.3.6 drug use (whether real or simulated).
8.4 Any use by you of personal numbers will be made in accordance with the terms and conditions for personal numbers, a link to which will be contained on the page of the Website where you obtain your personal number or as is otherwise notified to you.
8.5 If you provide us with your friend’s contact details via our MyPhone application, you shall be responsible to receive your friend’s permission to do this.
8.6 In the event that you breach any of the provisions above then we shall be entitled to take action against you including immediately preventing your access to the Website and/or Services or terminating your Membership or use of the Website and/or Services. Where we consider this appropriate and/or as may be required by law we shall take legal action against you including reporting you to any relevant law enforcement authorities.
9. OUR RIGHTS
9.1 We have the right to:
9.1.1 monitor, record and at our sole discretion, remove for any reason whatsoever any information or content and any other materials submitted by you ("Content"), particularly if we consider that the Content in any way breaches these terms and conditions or is otherwise against our policies or is in violation of the law;
9.1.2 prevent your access to the Website and Services and/or terminate your Membership or use of the Website and Services with immediate effect in accordance with the termination provisions below;
9.1.3 make changes to the Website and/or Services in our sole discretion or as required from time to time by law or applicable safety requirements;
9.1.4 to the extent permitted by law, copy, edit or reproduce any information submitted or transmitted by you on the Website and Services in any form.
10. YOUR USE OF THE WEBSITE/ VISITOR MATERIAL AND CONDUCT
You agree that in using the Service and Website You will not:
10.1. Use the Service or Website in any way that may lead to the encouragement, procurement or carrying out of any criminal activity;
10.2. Use the Service or Website for any purpose other than Your personal use, nor for any commercial purposes including, without limitation, leaving or distributing advertisements or promotions or offering, either directly or indirectly, services or goods for sale;
10.3. Record or leave any content or act in any manner which is defamatory, in breach of copyright or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religions, gender, sexual orientation, race, ethnicity, age or disability, or that is illegal;
10.4. Record or disclose personal data regarding another Service user or person including, without limitation, their email, address or other contact details that would enable another Service user to contact them without their express consent; or
10.5. Use the Service or Website to engage in discussion of any subject that is illegal or grossly offensive.
10.6. Please note that We may, at Our discretion monitor or record calls or messages for the purpose of ensuring compliance with these Terms, for training purposes and to investigate any complaints.
10.7. We reserve the right to suspend, restrict or terminate Your access to the Service at any time without notice at Our discretion where You are or We suspect that You may be in breach of these Terms.
10.8. We reserve the right to edit or delete any and all text, audio and video messages which We consider to be in breach of these Terms.
10.9. Where arranging to meet another user through the Service it is recommended that You inform a friend of Your plans and arrange to meet in a public place.
